The letting agent must update both the tenancy documents and the No Deposit plan when a tenant leaves, joins or is replaced. A verbal agreement or change of address does not by itself release an outgoing tenant or add an incoming tenant.
What must happen for an incoming tenant?
- The agent checks that the landlord and existing tenants agree to the change.
- The incoming person completes any required reference and identity checks.
- The agent prepares the correct signed tenancy amendment or replacement agreement.
- The agent adds the incoming tenant to the flatfair plan.
- The incoming tenant accepts the terms and pays any fee shown.
When is an outgoing tenant released?
An outgoing tenant should rely on written confirmation from the agent that the legal tenancy change is complete. Leaving the property, returning keys or asking flatfair to remove an email address does not automatically end liability under the tenancy agreement.
Does an outgoing tenant receive a No Deposit refund?
The original No Deposit joining fee is not refunded when a tenant leaves during an ongoing tenancy. It was a service fee, not money held as a deposit.
What should the household check?
- the effective date of the tenant change;
- the rent and rent shares after the change;
- the names in the signed tenancy document;
- the names and status shown in flatfair; and
- who is responsible for any charge relating to a period before the change.
Keep the check-in evidence, change-of-sharer document and any mid-tenancy condition record. These can show which tenant was responsible if a charge is proposed later.
