Once a request to dispute and adjudicate the proposed charges is received, the case is sent to an external third party adjudication service.
flatfair will notify all parties of a 5 day dispute cool-down period once an adjudication request has been received. This period is for both parties to finalise their evidence on the platform before the case is sent to the adjudicator. Once this cool-down period has lapsed, no further information can be added and the decision of the adjudicator will be legally binding.
Adjudication decisions can take up to 28 days to be returned and flatfair shall display this decision on the platform on receipt.
Any proposed charge referred to adjudication will be determined by the Adjudicator on the basis of written and photographic evidence provided by all parties. By using the flatfair service, all parties agree to provide any relevant written and/or photographic evidence in support of their position within 5 days of our request.
An adjudication decision is legally binding, and therefore can only be disputed by way of court.
