There are multiple reasons for which you would seek to extend a flatfair membership. The options available on our platform when carrying out an extension are:
- New fixed term or statutory periodic
If a tenant would like to renew their tenancy agreement or is moving into a periodic term past the fixed end date on their tenancy agreement, you will be able to extend the associated flatfair membership to a later date. The landlord will be obligated to let us know as soon as a tenant ends the renewed tenancy agreement.
- Possession proceedings in progress
In the circumstance of a landlord serving their tenant with a section 21 notice (ending a tenancy agreement) or section 8 notice (breach of contract) to evict them from a property, the flatfair membership may be extended if this process has been started but not completed. The landlord is then obligated to notify us of the eviction date ordered by the court and once the tenancy is officially terminated.
- Tenancy surrender in progress
If a tenant has not left the property by the specified date on their notice, the flatfair membership period may be extended to a later date.
- No communication/status unknown
If you are unable to contact your tenants to verify the status of the property you can notify us using this status and will be able to extend the flatfair membership. However, you will need to inform us promptly of any changes and ensure the flatfair membership is updated once the status is known in line with your obligations under the flatfair terms and conditions.
We are aware that an extension of a flatfair membership for any of these reasons may also be necessary due to COVID-19. For example, a landlord may have started possession proceedings but been unable to complete them due to the moratorium on possession cases in the courts; or a tenant may not have left the property by the specified date on their notice due to the need to shield or self-isolate. You’ll be able to specify that COVID-19 has impacted the flatfair membership during this process via a simple checkbox.
Please also note that, separately to flatfair membership extensions, if a tenant has surrendered a property before the tenancy has formally ended, it is a landlord's and/or a managing agent’s obligation to notify us once they are certain abandonment has occurred.
